CENTRAL INTERSTATE LLRW COMMISSION

EMERGENCY MEETING

FRIDAY, July 23, 2004, 8:00 A.M. - Overland Park, Kansas

 

In compliance with Commission Bylaws and Rules, a meeting notice announcing the date, time, location and agenda availability was mailed to the interested parties July 16, 2004.

 

An Emergency Meeting of the Central Interstate LLRW Commission was held Friday, July 23, 2004 so that Commission's counsel could update the commissioners on negotiations and to guide counsel as to further negotiations.

 

The meeting was called to order at approximately 8:09 A.M. and roll was called. Responding to the roll call were: Kansas Alternate Commissioner, Ron Hammerschmidt; Oklahoma Commissioner, Catherine Sharp; Louisiana Commissioner, Mike Henry; and Arkansas Commissioner, Laura Gilson. James O'Connell, Kansas Commissioner joined the meeting later and relieved the Alternate Commissioner from Kansas.

 

Also present was the Administrator, Rita Houskie, Court Reporter, Legal Counsel and interested members of the public and press.

 

No requests by members of the public were made to speak during the general public comment period.

 

The Chair gave a brief commentary on the reason for calling the emergency meeting and asked for a motion on the Declaration of Emergency.

 

Motion by Oklahoma, second by Louisiana, to approve the Declaration of Emergency (Resolution 1)

 

Motion passed 4-0

 

The Commission received a brief comment by outside legal counsel before the Chair asked for a motion to go into executive session for the purpose of a more in depth briefing by counsel on the progress of the negotiations with Nebraska.

 

Motion by Louisiana, second by Kansas, to enter into executive session to discuss and guide legal counsel as to further negotiations (Resolution 2)

 

Motion passed 4-0

 

The Commissioners went into executive session at approximately 8:15 A.M.

 

The Commissioners returned to open session at approximately 10:35 A.M. The Chair announced that there had been no actions taken during the executive session other than to instruct legal counsel as to further negotiations.

 

The Chair commented on the need to revamp the export application approval process and instructed the administrator to begin preparation for a more streamlined process.

 

Motion by Kansas, second by Louisiana, to adjourn the meeting.

 

Motion passed by unanimous acclamation

 

The meeting was adjourned at approximately 10:45 A.M.
